The Arms Act and Rules: An Understanding of the Foundation of Trust

The Arms Act, 1959 (“Act”), and the Arms Rules, 2016 (“Rules”) are the guidelines for trust and accountability in this sector. These regulations touch every single aspect of arms and ammunition - from who can hold them, to who can sell them, and most importantly who can manufacture them. These are the foundation for manufacturing arms and ammunitions in India. Some of the critical aspects for manufacturing arms and ammunitions in India are as follows:

License: Section 5 of the Act is crystal clear that you cannot manufacture, sell, or even repair firearms or ammunition without a specific license granted under this Act. A license is therefore non-negotiable. 

Categorization of arms and ammunitions: The Act and Rules are incredibly detailed, categorizing every type of arm and ammunition. The license will precisely define what you are allowed to manufacture, from the smallest cartridge to complex defence systems.

Special Authorization: In order to manufacture certain highly restricted items viz. the prohibited arms or ammunition, a special authorization from the Central Government will be required.

A Roadmap to Manufacturing Arms and Ammunitions 

Establishing an arms manufacturing business is a marathon that demands perseverance, a large financial outlay and obtaining a number of essential approvals and permits.

Establishing the Foundation of the Company:

In order to manufacture arms or ammunitions in India, a company must be:

  • An Indian company registered under the Companies Act, 2013.
  • The company must be owned and controlled by resident Indian citizens or by Indian companies which are themselves owned and controlled by resident Indian citizens except in respect of a company having Foreign Direct Investment (FDI) beyond forty-nine percent.

Opening the Doors with Licenses and Clearances:

The actual work starts at this point. Expect a multi-step process that involves dealing with multiple government bodies. 

Licensing Authority: The license is granted by the Ministry of Home Affairs (“MHA”).

How to Apply: Applications are typically digital, often through online portals specific to licensing authorities.

The Paper Trail: Following is non-exhaustive list of documentations for obtaining a license from MHA for manufacture of arms or ammunitions: 

1. Company Documents:

  • Memorandum and Articles of Association
  • Certificate of Registration under the Companies Act, 2013
  • Corporate Identification Number (CIN)
  • Proof of address of its registered office
  • Permanent Account Number (PAN) card of the company.

2. Certified copy of the Board Resolution for making the application, along with full particulars of the responsible person authorized to sign the application.

3. Copy of the latest balance sheet and audited Net-worth certificate duly certified by a Chartered Accountant.

4. Estimated project outlay and means of finance for funding the project, duly certified by a Chartered Accountant.

5. Details of foreign control and/or ownership in the applicant company (if applicable), duly certified by a Chartered Accountant.

6. Director/Responsible Person Documents:

  • Four passport-size copies of the latest photograph of each director and the responsible person (in white background).
  • Proof of date of birth for each.
  • Identification proof: Aadhar Card, or if not available, an affidavit along with an alternative ID (Passport, Voter ID, PAN card, or employee ID card).
  • Residence proof if Aadhar Card or Passport is not available (e.g., Voter's Identification Card, Electricity Bill, Landline Telephone Bill, Rent Deed, Lease Deed, Property documents, or any other document satisfactory to the licensing authority).

7. Complete details of the arms and/or ammunition intended to be manufactured, including their types and quantities.

8. Declaration with proof thereof to the effect that the application company has acquired the land for setting up the manufacturing plant along with details of access road to the proposed site, installation of electricity and water connection, particulars of land development carried out. 

9. Other Documents: Any other documents or information that the licensing authority may deem necessary.

Internal Processing and Verification: The application undergoes internal processing by the MHA and other relevant government agencies. This includes thorough police verification of the applicant, directors, and responsible persons. This verification covers:

  • Antecedents of the applicant.
  • Assessment of any potential threat.
  • Capability of the applicant company to handle arms safely and responsibly.

Inspection and Assessment: Authorities may conduct site inspections of the proposed manufacturing facility to ensure compliance with safety regulations, infrastructure requirements, and security protocols. They will assess the company's technical capabilities, financial stability, and overall suitability for manufacturing arms and ammunition.

Post-Licensing Obligations:

  • Proof Testing: All manufactured firearms must undergo mandatory proof testing.
  • Record Keeping: Maintain meticulous records of manufacturing, sales, and transfers.
  • Compliance: Strictly adhere to all conditions specified in the license and the provisions of the Arms Act, 1959, and Arms Rules, 2016.
  • Reporting: Submit regular reports to the licensing authority as required.
  • Renewal: Licenses typically have a validity period and require timely renewal.

Building the Fort - Infrastructure and Security:

Appropriate Equipment and Tools: The establishment is a high-precision workshop rather than merely a building. Accuracy depends on investing in state-of-the-art machinery, top-notch tools and cutting-edge equipment. 

Human Resource: Employing highly qualified engineers, technicians, and quality control specialist is crucial to understand arms technology and precision manufacturing.

Layers of Protection: Given the nature of goods, security is non-negotiable. A secure storage for every raw material and finished product, strict access controls, vigilant surveillance systems, and dedicated, highly trained security team must adhere to the Ministry of Defence's security manual.

Quality Control: To ensure that all arms and ammunitions manufactured meet the highest standards and required specifications, a strong quality control system must be put in place.
